("Company", "we", "us"), having its registered office in Pune, Maharashtra, India, and the user or entity ("Customer", "you") accessing our website or purchasing our products and services.

By accessing upbringingindia.com or placing an order/requesting a quote, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Product Information & Technical Specifications

While we strive for accuracy, the technical data, dimensions, and performance curves presented on this website (including for Atlas Copco, GEV, and Fipa products) are for reference purposes only.

• No Engineering Advice: The content on this site does not constitute professional engineering advice. Selection of vacuum systems should be verified by our technical team for your specific application.
• Modifications: Manufacturers reserve the right to modify product specifications without notice. We are not liable for discrepancies between the website data and the final delivered product version.

3. Quotes and Orders

• Quote Validity: All price quotations provided via our website or email are valid for 30 days unless otherwise stated.
• Acceptance: A request for a quote does not constitute a binding contract. A contract is formed only when we issue a formal Order Acknowledgement or Invoice.
• Pricing: Prices exclude GST, freight, insurance, and installation unless explicitly stated. We reserve the right to adjust prices due to exchange rate fluctuations or OEM price hikes prior to order confirmation.

4. Warranty & Returns

As an authorized distributor/trader, our warranty terms align with the Original Equipment Manufacturer (OEM) standards.

• Standard Warranty: Products are covered by the respective manufacturer's warranty (e.g., Atlas Copco standard warranty terms) against manufacturing defects.
• Exclusions: Warranty does not cover consumables (suction cups, filters, oil), normal wear and tear, or damage caused by improper installation, neglect, or use outside specified duty cycles.
• Returns: Goods once sold will not be taken back unless agreed upon in writing. Approved returns may be subject to a restocking fee (standard industry practice is 20%).

5. Intellectual Property

• Ownership: All content on this website, including text, graphics, and code, is the property of Upbringing Technologies or its content suppliers.
• Trademarks: "Atlas Copco," "GEV," "Fipa," and other brand names mentioned are trademarks of their respective owners. We use them strictly for identification purposes in our capacity as an authorized dealer/trader. You may not use these trademarks without express written permission.

6. Limitation of Liability

To the maximum extent permitted by Indian law:

• Indirect Damages: Upbringing Technologies shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of production, loss of profits, or downtime arising from the use or inability to use our products.
• Liability Cap: Our total liability for any claim arising out of a specific product sale shall not exceed the purchase price of that specific product.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

• Jurisdiction: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Pune, Maharashtra.
• Arbitration: We prefer to resolve disputes amicably. However, unresolved commercial disputes may be referred to arbitration in Pune under the provisions of the Arbitration and Conciliation Act, 1996.

8. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website or our services constitutes your acceptance of such changes.
